Trinity Guardrails have been linked to an increased risk of death and serious injuries after a whistleblower alerted authorities of fatal change in design as a cost cutting measure.

Ideally when a car or truck hits a guardrail, the head is supposed to slide along the guardrail and deflect it away from the car. However, Trinity Industries reported changed and the hid the fact that they changed the design of thier guardrails as a cost cutting measure. These design changes have lead to a number of car accidents that resulted in serious injury and death. Defective Guardrail lawsuits have been filed all over the country from victims of this fatal design flaw. The company previously without any warning narrowed the guardrails channel behind from 5 inches to 4 inches. This was reportedly done as a cost cutting measure to save $2 dollars on every rail head. This change in design caused the guardrails to impale some accident victims upon contact with the guardrails causing serious injury and in some cases death. Defective Guardrail Class Action

While there is not current a Defective Guardrail Class Action lawsuit, many individual lawsuits have been filed around the country. The benefits of a Defective Guardrail class action would be that it centralizes all investigative information into one location. These defective guardrail lawsuits would be difficult to consolidate into a class action due to the range of injuries. There has also been no word on if Trinity would create a Defective Guardrail compensation fund similar to the General Motors compensation fund. There have already been at least 14 lawsuits against Trinity with 5 reported deaths. The amount of Guardrails in each state is massive. In Arizona alone it is estimated that over 3,000 of the guardrail systems. Many states have banned the use of Trinity guardrails until further testing can be done to verify these products are indeed defective. At the very least, Trinty covered up the design change when it should have alerted the proper authorities.
